Overview

Agreement between the Government of Japan and the Government of the Russian Federation on certain aspects of cooperation in the fishing of marine living resources is a bilateral treaty between Russian Federation and Japan. It regulates navigation and commercial fishing by Japanese fishing vessels in the marine area delineated in the Agreement. This treaty is aimed at cooperation to enable Japanese fishing vessels to engage in the fishing of living resources in the marine area around the islands of Iturup, Kunashir, Shikotan, and Habomai, as well as to effect the conservation, rational use, and reproduction of the living resources in that marine area in accordance with this Agreement.

AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE RUSSIAN FEDERATION ON CERTAIN ASPECTS OF COOPERATION IN THE FISHING OF MARINE LIVING RESOURCES

The Government of Japan and the Government of the Russian Federation, hereinafter referred to as "the Parties",

Desiring to promote the development and strengthening of friendly relations between Japan and the Russian Federation,

Endeavouring to further develop and deepen traditional and mutually beneficial relations between the two countries in the field of fisheries, including relations based on the Agreement between the Government of Japan and the Government of the Union of Soviet Socialist Republics on Mutual Relations in the Field of Fisheries off the Coasts of Both Countries, signed on 7 December 1984 at Tokyo, and the Agreement between the Government of Japan and the Government of the Union of Soviet Socialist Republics on Cooperation in the Field of Fisheries, signed on 12 May 1985 at Moscow,

Based on the principles set forth in the Tokyo Declaration on Japanese-Russian Relations and the Declaration on the Prospects of Trade-and-Economic and Science-and-Technology Relations between Japan and the Russian Federation of 13 October 1993,

Attaching great importance to the further development of cooperation in the conservation, rational use and reproduction of living resources, including cooperation in protecting the marine environment,

Wishing to define the terms for temporary commercial fishing by Japanese fishing vessels in the marine area delineated in this Agreement, as well as for the conservation, rational use and reproduction of the living resources in that marine area,

Have agreed as follows:

Article 1

The Parties shall cooperate to enable Japanese fishing vessels to engage in the fishing of living resources in the marine area bounded by the straight geodetic lines that connect in succession the points with the coordinates given in the Annex around the islands of Iturup, Kunashir, Shikotan and Habomai, as well as to effect the conservation, rational use and reproduction of the living resources in that marine area in accordance with this Agreement.

Article 2

1. The fishing of living resources by Japanese fishing vessels in the marine area delineated in article 1 shall conform to the Memorandum of Understanding that is concluded annually between Organizations of both Parties, the names of which the Parties shall report to each other via the diplomatic channel.

2. Through the exchange of diplomatic notes, the Parties shall inform each other of their recognition of the agreement reached between the Organizations of both Parties under the Memorandum of Understanding referred to in paragraph 1 of this article.

3. The Japanese Party shall take measures that conform to the laws and regulations of Japan and that ensure that the Japanese Organization referred to in paragraph 1 of this article pays fees for the fishing, preservation and reproduction of the living resources in accordance with this Agreement and the Memorandum of Understanding referred to in paragraph 1 of this article.

Article 3

When it is in their mutual interest, the Parties shall endeavour to develop cooperation in bilateral fishery relations in general, including the exchange of information on the trends of the market prices for target fish stocks and the processing of target fish stocks. In accordance with the laws and regulations of both States, the Parties shall, if appropriate, encourage the development of cooperation in mutual commercial fishery operations between their organizations and enterprises.

Article 4

Based on a mutually agreed upon schedule, in general once a year, the Parties shall hold consultations on matters relating to the implementation of this Agreement.

Article 5

With regard to the implementation of this Agreement, the Parties shall, if appropriate, facilitate contacts between the competent authorities of both Parties – the Japanese Ministry of Agriculture, Forestry and Fisheries (Fisheries Agency), the Japanese Ministry of Transportation (Office of Maritime Safety), the Russian Federation Ministry of Agriculture and Food, and, inter alia, the Russian Federation Federal Border Service.

Article 6

This Agreement, as well as activities performed in accordance with this Agreement and measures to implement it, as well as any related activities and measures, shall not be deemed to prejudice the positions or views of either of the Parties on questions of mutual relations.

Article 7

1. This Agreement shall enter into force on the date of the exchange via the diplomatic channel of notifications of the completion by the Parties of the internal procedures necessary for its entry into force, and shall remain in force for three years, unless one of the Parties terminates the Agreement early by sending the other Party a written notification of the termination six months prior to the receipt of the termination.

2. Upon the expiry of the three-year period, this Agreement shall be automatically extended for successive periods of one year unless one of the Parties, at least six months prior to the expiration date of a given period of validity, sends the other Party a written notification of its intention to terminate the Agreement.

DONE at Moscow on 21 February 1998 in duplicate, each in the Japanese and Russian languages, both texts being equally authentic.
